2.7 Market Surveillance Plans

2.7.1      Authorities formulate market surveillance plans to target available physical and digital resources toward higher-risk product groups or operators with a documented history of non-compliance, ensuring a consistent, proportionate approach across the State.

2.7.2      Local plans must be aligned with the National Market Surveillance Strategy required under Article 13 of Regulation (EU) 2019/1020, focusing on product families within the scope of CPR 2011 and CPR 2024 that exhibit vulnerabilities related to life safety or significant environmental/carbon life-cycle deficits.

2.7.3      Authorities systematically identify and record relevant economic operators, including manufacturers, importers, and fulfilment service providers, within their administrative areas. Information from local planning and rates databases is cross-referenced with customs data and intelligence shared via the EU ICSMS portal. 

2.7.4      Implementation data must be recorded and continuously shared with the DHLGH and the NBCMSO, structured under harmonised Union reporting metrics:

  • total number of active (proactive and reactive) inspections executed (both physical site audits and desktop/DPP evaluations);
  • number of inspections resulting in a finding of non-compliance;
  • number of voluntary corrective actions taken by economic operators versus restrictive measures enforced by the authority;
  • number of successful prosecutions and applied financial penalties;
  • number of files where cost-recovery mechanisms were initiated to reclaim inspection, storage, or laboratory testing costs; and
  • number of investigations requiring cross-border cooperation with other EU Member States via the ICSMS framework.

2.7.5      Independent inspection remains the primary duty of individual local authorities. However, administrative cooperation platforms (such as the EU AdCo groups) allow coordinated regional clusters to share technical expertise, testing resources, and market intelligence to maximise overall enforcement efficiency.
