2.6 Resource management

2.6.1      Market surveillance involves a balance of routine active profiling/market screening and reactive inspection/sampling. In accordance with Article 13 of Regulation (EU) 2019/1020, resources must be allocated efficiently based on a national market surveillance strategy, concentrating enforcement where risks are statistically higher or non-compliance is more frequent. The NBCMSO are responsible for delivering on the national market surveillance strategy.

2.6.2      Reactive surveillance responds directly to accident reports or incoming third-party allegations. However, modern regulations mandate a transition toward high-visibility active programming, empowering authorities to execute unannounced spot checks and use digital market monitoring tools. 

2.6.3      Market Surveillance Authorities must possess the resources and competence to regularly visit commercial and e-commerce fulfilment premises, organize random spot checks, take sample units for laboratory testing (including online marketplace procurement), and compel access to machine-readable registries within the DPP system.

2.6.4      Local authorities promote regulatory awareness to foster compliance with CPR 2011, CPR 2024, and S.I. No. 669 of 2025 by:

  • incorporating updated guidance material and Authorised Officer contact data on local authority websites;
  • hosting direct links to portals managed by the NBCMSO and the Department; and
  • auditing local business registries and planning data to maintain a digital operator database for risk-based target scheduling and mass safety alerts.
