2.4 Authorised Officers
2.4.1 Regulation 8 of the European Union (Construction Products) Regulations 2025 requires Market Surveillance Authorities and Competent Authorities to appoint Authorised Officers to investigate, prevent, detect, request corrective action and/or prosecute offences. Officers are required to carry and produce this authorisation upon request when exercising their powers.
2.4.2 Regulations 9 (Powers of authorised officers) and 11 (Corrective actions) of S.I. No. 669 of 2025, gives powers to Authorised Officers to:
- inspect manufacturing, storage, distribution, transport, and online sales activities relating to construction products.
- request technical documentation, supply chain information, records, and explanations from economic operators.
- carry out inspections, evaluations, examinations, testing, reverse engineering, and unannounced visits.
- take samples of products for testing, obtain and/or take photographs, copies, or extracts of records’
- share information with national and EU market surveillance authorities to support enforcement and cooperation.
- where serious risks are identified, direct economic operators to take corrective action within a specified period.
- require non-compliant product content to be removed from websites or warnings displayed online.
- if necessary, require internet service providers to restrict access to online interfaces promoting non-compliant products.
- entre onto to a private dwelling with either the occupier's consent or a District Court warrant.
- protect confidentiality of technical documentation and information obtained during investigations.
- recover costs of testing non-compliant products from the relevant economic operator.
2.4.3 Where an Authorised Officer has sufficient reason to believe a product fails to achieve its declared performance or presents a public risk, they shall execute a technical evaluation under the mandates of CPR 2011 and/or CPR 2024, and economic operators are legally required to cooperate fully.
